Pennsylvania ARD & PWOV Expungements

A person who successfully completes ARD is “entitled” to have his or her record of arrest expunged, unless the Commonwealth demonstrates an “overriding societal interest” in retaining the record of arrest.

Commonwealth v. Armstrong, 434 A.2d 1205 (Pa. 1981).  

It is important to note that the Commonwealth is permitted to maintain a list of the people who participated in those programs for their future reference.

Further, certain sex offenses are not elidable for expungement if disposed of with ARD, if the victim was under 18 years old at the time of the offense (Rape, Statutory Sexual Assault, Involuntary Deviate Sexual Intercourse, Sexual Assault, Aggravated Indecent Assault, Indecent Assault, Indecent Exposure, Prostitution, Sexual Materials).
