18 Pa.C.S. § 9122(a)(3): Underage Alcohol Conviction Committed at Ages 18–20

A person convicted of 18 Pa.C.S § 6308 (relating to purchase, consumption, possession or transportation of liquor or malt or brewed beverages) is entitled to expungement provided when they reach 21 years of age, provided they:

• Were at least 18 years old at the time of the offense; and,
• Satisfied all terms and conditions of the sentence imposed for the violation, including any driver’s license suspension.

This expungement will remove any information concerning the offense from their PennDOT Driver History.

This rule is interesting because it only applies to offenders ages of 18, 19, and 20. As explained in the section relating to Juvenile Expungements below, a person convicted of section 6308 while under the age of 18 is generally eligible for expungement once they reach age 18 and 6 months pass from when they satisfy all the penalties of the offense.

18 Pa.C.S. § 9123(a)(2.2): Underage Alcohol Conviction Committed Prior to Age 18

Once the individual is 18 years of age or older and has been convicted of a violation of section 6308 which occurred while the individual was under 18 years of age and six months have elapsed since the individual has satisfied all terms and conditions of the sentence imposed for the violation, including any suspension of operating privileges imposed under section 6310.4 (relating to restriction of operating privileges). Expungement shall include all criminal history record information and all administrative records of the Department of Transportation relating to the conviction.
